1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via my online shop shop.kirstenschankweiler.com.

2. Contracting Party, Conclusion of Contract

The purchase contract is concluded with the independent artist Kirsten Schankweiler.

The presentation of artworks in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

You may initially place the desired artworks in the shopping cart without obligation and review and correct your entries at any time before submitting your order as part of the ordering process.

By clicking the final order button, you place a binding order for the items contained in the shopping cart. Receipt of your order will be confirmed by email immediately after the order has been submitted.

3. Delivery

Delivery will be made to the delivery address provided by the customer during the ordering process.

Available artworks are generally carefully packed and dispatched within 3–5 business days after receipt of payment.

Any applicable shipping costs will be displayed during the ordering process. For deliveries to countries outside the European Union, additional customs duties, import charges and taxes may apply and must be borne by the buyer.

If, in exceptional circumstances, an artwork is unavailable, I will inform you immediately. Any payments already made will be refunded in this case.

4. Payment

The payment methods available in the online shop will be displayed during the ordering process.

Payment is due immediately upon conclusion of the contract, unless otherwise specified for the selected payment method.

Payment processing is carried out via the respective selected payment service provider in accordance with its applicable terms and conditions.

5. Right of Withdrawal

Consumers have the statutory right of withdrawal as described in the cancellation policy. No voluntary right of withdrawal is granted to businesses.

6. Retention of Title

The goods remain my property until payment has been made in full.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such damage to the carrier as soon as possible and contact us immediately.

Failure to make a complaint does not affect your statutory rights or warranty claims. However, by doing so, you help us to assert our own claims against the shipping service provider or transport insurer.

8. Warranty and Guarantees

The statutory warranty rights apply to our goods.

9. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
